Earnest Money - Important News for Both Buyers and Sellers!

Earnest Money - EMD - Deposit - whichever term is used in your locale it is extremely important to know what it is, what it is used for and what the appropriate amount is.  I will use real life to demonstrate the importance of educating other professionals, buyers and sellers the necessity Earnest Money.

I have a buyer couple from out of state.  They are the nicest, most hard-working, upstanding people that you would ever want to be around.  They placed their property for sale in the "other" state with Agent X so that they could start the preparations for the move to North Carolina.  It didn't take long.  Agent X received an offer from Agent Y that was representing the buyer.  The initial offer came in with $0.00 Earnest Money.  Let me put that a few other ways for you to understand.  ZERO - $o.oo- zip, zilch, nada. 

I was not privy to any of the negotiations with their "other" property as things happened literally within hours.  Their agent, Agent X, countered with earnest money of $300.00.  Again, for emphasis, THREE HUNDRED DOLLARS!  I did not know any of this.  When I would ask my buyer any questions they said that their agent was handling things beautifully.  Okay.

We find THE house in the Wake Forest area.  I mean THE house!  Their property is under contract so all is contingent.  Before writing our offer I informed my buyer that I needed a copy of their Offer To Purchase for the property in the other state.  I wanted to be sure that the contract looked good and, of course, had to have it when we submitted our offer. 

Agent X obliged and emailed me the contract.  I was FLOORED when I reviewed it.  I immediately called my buyers (Agent X's sellers) and asked if they understood what the earnest money was for, what did they know about the buyer, were they pre-qualified or pre-approved, etc.  I then explained that if the deal feel apart and provided the stars aligned perfectly that they would only be entitled to $300.00.  Again, I was informed, no worries - "Our agent is great and this is solid."

Once my buyers had reviewed the information that I gave them by way of comps, etc they were prepared to make their offer.  When it came to Earnest Money they were floored.  I explained to them that customary for our area is 1% - 3% of the purchase price.    They couldn't understand why.  I explained to them what earnest money is for.  It can be viewed as "good faith".  It can convey a level of seriousness.  By putting up a larger amount of earnest money it shows the seller that you are serious about buying their house.  It also indicates that you have taken the steps necessary to be pre-approved since you (as the buyer) may lose that money should the deal fall through.  It is a level of commitment to the process.  It is an indicator of your intentions.

Once it was explained my buyers understood completely and were now kicking themselves for not asking for much more in their transaction with Agent X and Agent Y. 

Moving forward, all seems to be going along quite well with one exception.  There was minimal communication between myself and Agent X.  Not due to a lack on my part.  I emailed, I called and I even sent up smoke signals - nothing in return. 

First closing date of July 10 approaches.  My buyers lender says it's a "go" for closing.  FINALLY I hear from Agent X and I am told that there were a few hiccups.  Okay - we've all dealt with those - they happen.  We pushed the myspace code

 

closing to the 18th.  Two days prior I find that they are no longer hiccups but belches.  It would seem that the buyer in the other state had decided it would be okay to buy major purchases and write some not so worthy checks prior to closing.  Yikes!  The deal was pushed to a Mortgage Broker that claimed "I can get any loan through."  Well, guess what?

DENIED!  By TWO LENDERS and a Mortgage Broker!

My buyers deal has flopped.  For all of my buyers troubles they "might" get $300.00.  That's it!  They now CAN'T move to NC and the husband will have to call Monday to decline the position he was offered here.  Not only can they not buy the house but their life has been dramatically alteredWill my buyers lose their $1500.00?  Technically, they should.  However, the other agent here and myself have been in very close contact and they have been a dream to work with.  There may be a chance that it will be returned to my buyers.

So, to whomever is reading this, whether buyer, seller or fellow agent - PLEASE be sure you understand every piece of an Offer To Purchase and the consequences should a deal not go through.  Don't let any agent rush you through a contract - take all the time you need to really understand it!

As for me and my buyers?  We'll figure something out - that's what I am here for.  I have listened to numerous tearful phone calls this afternoon.  It was my job to tell them that we will work through this.  Just because this deal didn't work doesn't mean that their aren't alternatives.

Texas Roadhouse and the Wake Forest Police Department are sponsoring a fundraising event for the Special Olympics of North Carolina on July 30 from 4 p.m. to 10 p.m. Come and enjoy dinner at Texas Roadhouse and a portion of the dinner proceeds will be donated to the Special Olympics Program, which allows those with intellectual disabilities to demonstrate courage and experience joy through competition! Festival Friday

Festival Friday is scheduled to be held each Friday from June 6 through October 17 on the grounds of Festival Park. In case of rain, the festivities will move indoors. Admission is $3. A portion of the proceeds goes to the Graham Johnson Cultural Arts Endowment. The point of Festival Friday is to provide a venue every Friday night for local teens to gather in a safe, fun environment and encourage local artists to show off their skills. Prizes will be awarded each week to select Festival Friday performers. Area residents are encouraged to bring your lounge chairs, blankets and enjoy. Wow - where has this summer gone?  I see school supplies galore in the stores, the latest school fashions are up in most stores and I have actually heard the whines of bored kids ready to go back to school!  I can't believe we are approaching the end of summer - unbelievable!

This week in Wake Forest proves to be a little more on the conservative side - most families are getting in that last hurrah before getting serious about going back to school.  Here are a few events that will keep you entertained and happy as the mid-point of your summer has now passed.

Wake Forest, NC - SPECIAL EVENTS Highlighted

One of the most exciting things about living in Wake Forest are the wonderful events and activities that take place throughout the year.  They provide a great opportunity for residents to partake in the community, meet new friends and just have a good time!  Every week I highlight what is upcoming for the following week in Wake Forest and I hope that you have found the information useful in planning your week.

Here is a brief list of some of the Special Events that are yet to come the rest of the year:

Halloween Spooktacular (ages 12 and younger):  Flaherty Park Communty Center - October 23 from 6:30 - 8pm

  • A variety of ghostly games and activities will be offer. Costumes are optional but a prize for "best costume" will be awarded. Free pumpkins will be given away while supplies last.  This event is FREE!

The Princess and The Pea:  Wake Forest Community House - September 18 at 2:30 and 4:30pm

  • Shows are co-sponsored by the Wake Forest Parks & Recreation Department and United Arts of Raleigh and Wake County.  This event is FREE!

Concert In The Park:  Holding Park - October 5 from 3pm - 5pm

  • This popular community even is offered by PineCone.  Co-sponsored by the Wake Forest Parks & Recreation Department and United Arts of Raleigh and Wake County.  Bring a chair or blanket and enjoy the music!  This event is FREE!

The Zany Zoo:  Downtown Wake Forest - October 11 at 2:00pm

  • Lee Bryant, "The Puppet Guy" will present "The Zany Zoo" at the Autumn Arts Festival.  Sponsored by Wake Forest Parks & Recreation Department and United Arts or Raleigh and Wake County.  This event is FREE!

Newton Circus:  Wake Forest Boys & Girls Club - November 19 at 4:30pm

  • Mad Science and Dr. Rocket will present amazing science experiments right before your eyes.  Sir Isaac Newton will transport you to the role science played in our past and will help us look at what role it plays in the future.  Sponsored by Wake Forest Parks & Recreation Department and United Arts of Raleigh and Wake County.  This event is FREE!

Calls From Santa (ages 3-7):  December 11 from 6:oo - 8:oopm

  • Children can receive a personal phone call from Santa this Christmas!  Registration forms will be available on the Town's website beginning December 1.  All forms must be returned no later than 5pm on December 10.  This event is FREE!

The Wake Forest Parks & Recreation Department does an amazing job of coordinating events throughout the year and are just one of the reasons why I am so happy in My Back Yard....

Public Transit - Ever Wonder What You'd Save?

You may remember a post I did - Public Transit Coming To Wake Forest - Getting Around Just Got Easier! - about a month ago and the excitement it generated providing ease and convenience getting around Wake Forest and into Raleigh.

Well, I just found this GREAT tool that you can use to estimate how much money you can save by using Public Transit for commuting

As you can see, this handy little tool (just click on the picture) allows you to input your own information to calculate your annual savings!  Pretty handy to have and a great factor in deciding whether you want to use more Public Transit to get around.

As for Wake Forest Public Transit?  It has been VERY well received in the area!  Remember, the Wake Forest loop is free through December 31, 2008!  You can't beat that!  As for the Wake Forest - Raleigh Express?  Only $2.00 - $2.50 each way depending on the time of day. 

I love Wake Forest!  The conveniences offered just keep getting better!

Wake Forest, NC Market Report for June 2008

As is the trend in most of the country our Active Listings in Wake Forest are up.  As indicated by the chart below listings are up 25% for Wake Forest.

The next chart will help you to visualize the month to month trend from January 2008 through June 2008 of active listings in Wake Forest.  While the trend overall for the year may be up there does not to appear to be any wild fluctuations from month to month.

While the overall aborption rate for the country is reported at 11 it would appear that Wake Forest is bucking the trend.  We have had a steady decline in our absorption rate since January 2008 and are currently at 9. 

Lastly, Wake Forest maintains a healthy portion of sales in Wake County overall.  Wake County had aproximately 6991 sales with Wake Forest capturing 12%.

What Is The Going Commission To Sell My Home?

This could be a very simple post - I could easily say "There isn't one!" and be done with it.  However, I have noticed lately that there still seems to be the misconception among the general public that there is a set commission that a Real Estate agent (whether Realtor® or not) charges to sell your home.  There simply isn't which leads to another question....

What are discount brokers?  Again, a simple answer - I have never met one

There are, however, two different types of Real Estate companies.  Traditional (Full Service as some like to call themselves) and Limited Service (a more a la carte type menu of services)

Traditional Firms: 

•·     Market your property to the fullest within the guidelines set forth by their respective company.  Such advertising MAY include listing your property in the Multiple Listing Service, Open Houses, internet based advertising, interior and/or exterior flyers for your home, local newspaper ads, email advertising, etc. 

•·     Full representation* when negotiating contracts, preparing paperwork, working on behalf of the seller, coordinating details of closing such as inspections, appraisals, closing, etc.

•·     Marketing materials such as yard signs, websites, etc.

•·     Lockbox for your home

•·     Some MAY include appointment setting services for showings of your home

By no means is the above list a TOTAL representation of what a Real Estate agent can do for you.  It is merely presented to show the difference between the types of companies that are available. 

Limited Services Firms:

These firms will generally offer services as "add-ons" to help you to sell your home.  They may ask for a fee up front (or may not) and offer you services for individual fees such as:

•·     Multiple Listing Service

•·     Flyers

•·     Representation

•·     Contract Negotiations

•·     Coordinating Closing

•·     Advertising (multiple avenues)

When selling your home there are numerous models available to choose from and one is not better than the other depending on a seller's precise situation.  Each scenario garners a unique approach.  So, while you may have heard that Real Estate agents charge X% to sell your home - it is simply not true. 

So, if the end result is ultimately the same - GET YOUR HOUSE SOLD - then the burden rests with the consumer to do their homework and interview many Real Estate agents before trusting one of their biggest transactions to another.  Interview Real Estate agents from both fields - Limited Service and Full Service - choose the agent with whom you are comfortable and feel you can trust, confide in and will serve your best interests.  Again, each seller is different, each Real Estate firm is different.  This is a service based field - as with any other service oriented company there is a broad range of prices for services to pay as well as services offered.

I, in no way, mean to cheapen MY profession but one analogy that comes to mind is servicing my car.  I can take my car to the dealer to have services performed.  When I leave my car has been washed, I have a flower on my dashboard, the car has been vacuumed and I have had free doughnuts and coffee while waiting.  That's if I chose to wait or I could be shuttled to where I need to go until my car is done.  OR I can take my car to the local mechanic who I trust and have the same work done by someone that I know and have confidence in.  No flower, no coffee and doughnuts, no car wash and vacuum.  The same quality work was performed, the same diagnostics were done and I was somewhere that they knew me, cared about me and my circumstances and I was comfortableYou can put all the frills on a service but that doesn't guarantee the quality or professionalism.
